The Clients agree to provide a meal for the photographer if the length of attendance exceeds five hours.The Client/s and the Photographer consent to cooperate and communicate with each other to achieve the best possible result within the understanding of this contract. It is also the responsibility of the Clients to raise any potential concerns or queries regarding the contract or otherwise to help the day and resulting photographs be of the highest quality and ease for both parties. The Photographer shall not be responsible for photographs not taken as a result of the Client’s failure to provide reasonable assistance or cooperation. The Clients will use their best endeavors to provide the Photographer with a helper (usually a trusted wedding party person or family member) who will assist in pointing out key individuals to be photographed. The Photographer may also require their assistance in organizing family groups.The Clients also agree to give reasonable warning of key events at the wedding to give the Photographer time to prepare (examples include but are not limited to; Bouquet toss, cutting of cake, first dance, speeches etc).Please also note that not all guests at weddings like having their photo taken. In such cases the decision will be in the discretion of the Photographer, but the Photographer cannot be held responsible for a lack of photos of these people.The Clients acknowledge and endeavor to do their best to ensure that the Photographer get precedence over guests or hired content creators to take photos to ensure that the day is most successfully captured. Photographer will not be liable for a lack of wedding photos if guests or content creators taking their own photos of the Clients interrupt the Photographer’s work.Photographers are sometimes limited by rules imposed by registrars, ministers, and venue management as to what can and cannot be done. For example, some ministers insist that no flash photography is allowed, and others will insist that the Photographer shoot from a specific location. In such circumstances the Clients agree to accept the technical limitations that may be imposed on the equipment used. The Clients are responsible to make themselves aware of the rules of the venue concerned and if necessary, negotiate with the personnel concerned.The Clients understand that the agreed service and price upon booking cannot be changed to a lower package after initial payment is made, and photography can only be upgraded to a higher package or additional hours should the Clients so choose.The photographs taken by the Photographer are for private use only of the Client/s and are not for any commercial use. The copyright of images remains the ownership of the Photographer. Sale, Publication or any Commercial use of the photographs is not allowed without prior written permission from the Photographer. The Client/s grant the Photographer and its legal representatives, heirs and assigns, the irrevocable and unlimited consent to use the photographs of the Client/s for editorial, competition, advertising and any other purpose and in any manner, to alter the photographs without restriction; and the copyright of such altered images. The Client/s hereby release the Photographer and its legal representatives, heirs and assigns from all liability and claims in connection with the altered images.If the Photographer is too ill or becomes injured or has some other unforeseen difficulty and cannot supply the wedding services specified above, the Photographer will use the Photographer’s best endeavors to book a replacement wedding photographer at no additional cost to the Clients. If a replacement photographer cannot be found, the liability is limited to a complete refund of any payments received.The Photographer retains the right to be safe at all times, and exposure to any form of harassment, witness to objectionable conduct or any illegal acts, or placed in a position where the Photographer is made to feel unsafe, The Photographer has the right to immediately terminate the agreement and leave the venue, and the Clients will not beentitled to a refund.The Photographer has working methods in place to prevent loss or damage to your images. However, in the event that images may be lost, stolen or destroyed for reasons beyond our control, liability is limited to the return of fees paid for the service or part thereof according to the percentage of images still able to be supplied.Client is responsible for the safe keeping and storage of digital files and photographs once delivered, and understands that deliverable file storages such as USBs are subject to a 2 year lifespan and should be backed up accordingly.This contract between Cobie Sinclair Photography and the Client will not be effective until it is signed and the initial amount (30% non-refundable booking retainer) has been paid. At the time the contract takes effect, Cobie Sinclair Photography will reservethe date and time agreed upon and will not make any other reservations or accept any other clients for the date and time agreed upon. For this reason, in the event that the Clients cancel the contract for any reason, all monies paid shall be retained by Cobie Sinclair Photography in order to offset its loss of business.We have read and understood the contents of this contract and agree to the terms therein,
